ADMINISTRATIVE OFFENSE REPORT

Folk wisdom says that a smart person learns from his mistakes, a fool does not draw conclusions from mistakes at all, and only a wise person learns from the mistakes of others.

Therefore, we want to share with you the nuances and our own experience in drawing up an administrative offense report under Article 124 of the Code of Administrative Offenses (road accident), and other important details, in order to avoid or at least minimize the consequences of such a nuisance as a road accident.

Usually, a road accident, even if it is minor or happened through no fault of yours, is not a pleasant and long-lasting thing, years can pass from the moment the accident occurred to its logical conclusion, and all because of trifles.

– First of all, after the accident occurred, you need to master your own emotions and call the police to the scene of the accident;
– If there were witnesses nearby, ask them to stay and provide written explanations about the event they witnessed, if they categorically refuse to wait for the patrol police, ask them to leave their contact details (name, phone number, video from the recorder, etc.);
– Take photos and videos of the location of the vehicles after the accident, their damage and road conditions;
– When drawing up the report itself, check the correctness of the data entered in the report, namely the name of the vehicles and their license plates, the date and time of the accident, the section of the road where the accident occurred, the coordinates of their location relative to the elements of the roadway, the place of collision, brake tracks and other objects that have evidentiary value for the case;
– We should not forget about the debris from cars left on the roadway, it indicates the place of collision, since the wreckage of the car remains at the place of impact by cars, weather conditions, time of day, all this is of great importance for the court to decide the issue of bringing a person to justice under Article 124 of the Code of Administrative Offenses;
– In addition, it is very important to check the points of the traffic rules of Ukraine that were violated by the driver (culprit) of the accident, so that they are correctly indicated in the protocol of the administrative offense, since the court, when considering the case, cannot go beyond the protocol and considers the presence or absence of violation of the specified points by the driver;
– It will not be superfluous to seek help from a lawyer, if there are video cameras nearby, then the owner of the cameras is obliged to provide a response to the lawyer’s request within five working days, and with it the video of the accident itself.

The most important thing to remember is that after any trouble, you should remain human, offer help to the other party, and if necessary, provide it, and thank God that everything happened without serious consequences and only the iron was damaged, because human life is priceless.
